Preserving your accident case

One of the most important things you should do after being involved in an automobile accident is preserve any and all evidence that may be available to you.  You should not hesitate in taking pictures, going to the doctor or hospital, obtaining the police report, obtaining names of witnesses and contacting an attorney. An attorney can assist you in preserving and obtaining any potential evidence.  Without immediate action, much of the evidence that you will need to prove your claim can be lost.   If you were ticketed for a moving violation (this does not include failure to have registration or insurance), do not plead guilty or pay the fine before speaking with a lawyer. Even in cases where the police ticket you, a qualified lawyer may be able to take your bodily injury case.

Statute of limitations & notice requirements

A statute of limitations sets a specific time frame in which a particular type of law suit can be brought.  If you do not meet the deadline, then you will be forever barred from bring suit.  In Connecticut, a two year statute of limitation applies to claims involving automobile accidents.

 

See Connecticut General Statute § 52-584. In the case of an action for injuries resulting in death, however, the action must be brought within two years of the date of death and not more than five years from the act or omission complained of.  See Connecticut General Statute § 52-555.   In addition, certain claims are subject to notice requirement.  For example, any claim against a municipality or the State of Connecticut is subject to severe notice restrictions.  These notice requirement must include certain information and be filed within a strict time period.  If all of the requirements are not met, you will be prevented from bringing your claim.   To properly assess and determine the applicable statute of limitations and any notice requirements that may be associated with your claim, it is imperative that you contact an attorney.

You have rights after a motor vehicle accident

You have the right to have your car repaired in a reasonable time. You also have right to select a body shop of your choosing.  In the event your car is determined to be a total loss (“totaled”), the insurer is required to provide you the reasonable fair market value of your vehicle. This value must be collected from three different sources.   

 

Connecticut Public Act No. 09-240 entitles you to written disclosure of another driver’s insurance policy limits. This information is important to learn, particularly in cases where you have sustained significant injuries and the other driver does not have adequate coverage to compensate you for your harms and losses. There are certain requirements for obtaining this information. You should consult with an attorney for details on how to obtain this information.
